1 - لصاحب العقار الذي لا يتصل بالطريق العام او ان وصوله اليه يتم بنفقة باهظة او مشقة
كبيرة حق المرور
في الارض المجاورة بالقدر المألوف لقاء مقابل عادل.
2 - على ان هذا الحق لا يقوم الا في موضع يتحقق فيه نفعه ويقل ضرره.
