للمدين في الدين المرهون ان يتمسك قبل الدائن المرتهن بأوجه الدفع المتعلقة بصحة الحق
المضمون بالرهن وكذلك
بأوجه الدفع التي تكون له هو قبل دائنه الاصلي ، كل ذلك بالقدر الذي يجوز فيه للمدين في
حالة الحوالة ان يتمسك بهذه
الدفوع قبل المحال اليه.
