1 - لصاحب خيار الشرط الحق في فسخ العقد او اجازته.
2 . - فان اختار الاجازة لزم العقد مستندا الى وقت نشوئه
3 . - وان اختار الفسخ انفسخ العقد واعتبر كأن لم يكن
