يجوز في الاشتراط لمصلحة الغير ان يكون المنتفع شخصا مستقبلا او جهة مستقبلة كما يجوز ان
يكون شخصا او
جهة لم يعينا وقت العقد، متى كان تعيينهما مستطاعا وقت ان ينتج العقد اثره طبقا
للمشارطة.
