تتم الاقالة بالايجاب والقبول في المجلس وبالتعاطي بشرط ان يكون المعقود عليه قائما
وموجوداً في يد العاقد
وقت الاقالة ولو تلف بعضه صحت الاقالة في الباقي بقدر حصته من العوض.
