1 - تسري على التصرف الانفرادي الاحكام الخاصة بالعقود الا ما تعلق منها بضرورة وجود ارادتين
متطابقتين
لنشوء العقد. وذلك ما لم ينص القانون على غير ذلك.
2 - ويبقى الايجاب في العقود خاضعا للاحكام الخاصة به.
