اذا حصل الوفاء من غير المدين وترتب عليه ان الدائن وهو حسن النية قد تجرد من سند الدين او
مما حصل عليه.
من التأمينات، او ترك دعواه قبل المدين الحقيقي، المدة المحددة لسماعها ،فلا يجب عليه رد ما
قبض، ولمن اوفى ان يرجع
على المدين الحقيقي بالدين وبالتضمين ان كان له محل.
