3 - دعوى عدم نفاذ تصرف المدين في حق الدائن:
: احاطة الدين بمال المدين
اذا احاط الدين حالا او مؤجلا بمال المدين بان زاد عليه او ساواه فانه يمنع من التبرع تبرعا لا يلزمه
ولم تجر العادة به وللدائن ان يطلب الحكم بعدم نفاذ هذا التصرف في حقه.
