اذا أبرأ الدائن أحد المدينين المتضامنين من الدين او من التضامن فلباقي المدينين ان يرجعوا
على هذا المدين
بنصيبه في حصة المعسر منهم الا اذا كان الدائن قد أبرأه من كل مسؤولية من الدين فان الدائن
يتحمل نصيب هذا المدين
في حصة المعسر.
