1 - يضمن البائع سلامة المبيع من اي حق للغير يعترض المشتري اذا كان سبب الاستحقاق سابقاً
. على عقد البيع
2 - ويضمن البائع ايضا اذا استند الاستحقاق الى سبب حادث بعد البيع ناشىء عن فعله.
