1 - يلزم لنفاذ العقد ان يكون المؤجر او من ينوب منابه مالكا حق التصرف فيما يؤجره.
2 . - ينعقد ايجار الفضولي موقوفا على اجازة صاحب حق التصرف بشرائطها المعتبرة
