1 - اذا لم يبين في العقد مدة للمساقاة تنصرف الى اول غلة تحصل في سنة العقد ما لم يجر

2 - واذا حدد في العقد مدة يحتمل فيها ظهور الثمر ولم يبد اصلا فلا يستحق احد العاقدين شيئا
