اذا كانت العارية من الاشياء النفيسة وجب على المستعير تسليمها بنفسه الى المعير، اما
الاشياء الاخرى
فيجوز تسليمها بنفسه او بواسطة من هم في رعايته من القادرين على تسليمها.
2 - يجب رد العارية في المكان المتفق عليه والا ففي المكان الذي اعيرت فيه او يقضي به
. العرف
3 - اذا كان المستعير ميتا فلا يلتزم ورثته بتسليمها الا في مكان وجودها.
