اذا غاب المودع غيبة منقطعة وجب على المودع لديه حفظ الوديعة حتى يتحقق من موته او
حياته فان كانت الوديعة
مما يفسد بالمكث كان عليه ان يطلب من المحكمة المختصة بيعها وحفظ ثمنها امانة بخزينة
المحكمة.
