1 - يجوز الاتفاق على اعفاء المؤمن من الضمان اذا اقر المستفيد بمسؤوليته او دفع ضماناً
للمتضرر دون رضاء
المؤمن.
2 - ولا يجوز التمسك بهذا الاتفاق اذا كان اقرار المستفيد قاصراً على واقعة مادية او اذا ثبت ان دفع
الضمان كان في
صالح المؤمن.
