Article text
1 - اذا ادى الاصيل الدين قبل اداء الكفيل او علم باي سبب يمنع الدائن من المطالبة وجب عليه
اخبار الكفيل
فان لم يفعل وادى الكفيل الدين كان له الخيار في الرجوع على الاصيل او الدائن.
2 - واذا اقيمت الدعوى على الكفيل وجب عليه ادخال الاصيل فيها فان لم يفعل جاز للاصيل ان
يتمسك قبله بكل ما كان يستطيع
ان يدفع به دعوى الدائن.
