أ- اذا وجد بالحساب ان الراتب الشهري الذي يستحقه كل فرد من افراد العائلة بموجب احكام
المادتين الخامسة والثلاثين
والاربعين من هذا القانون يقل عن دينار واحد فيخصص لكل منهم دينار واحد في الشهر كحد
ادنى شرط ان لا تزيد رواتب
التقاعد التى تخصص لجميع افراد العائلة عن راتب التقاعد الذي استحقه مورثهم.
ب- واذا وجد بالحساب ان الراتب الشهري الذي يستحقه كل فرد من افرادعائلة الموظف المتوفي
بموجب احكام المادة الحادية
والاربعين من هذا القانون يقل عن دينار واحد فيخصص لكل منهم دينار واحد كحد ادنى شرط ان
لا تزيد رواتب التقاعد التي
( تخصص لجميع العائلة على خمسة وسبعون بالماية 75 ) من راتب مورثهم الشهري الاخير. %
