أ -في العقار المؤجر لغايات السكن قبل ? 31/8/2000 فانه يحق لافراد اسرته الذين كانوا يقيمون
معه في العقار عند وفاة المستأجر الاستمرار في
اشغال المأجور لمدة ثلاث سنوات من تاريخ نفاذ هذا القانون او من الوفاة ، أما العقار المؤجر
لغايات اخرى فيستمر ورثة المستأجر الشرعيون او
احدهم في اشغال المأجور لمدة ست سنوات على ان يراعى أجر المثل في كل الاحوال 0
ب- يستمر حق اشغال المأجور لغايات السكن الى الزوجة المطلقة طلاقاً بائناً او انفصالاً كنسياً
باتاً لمدة ثلاث سنوات من تاريخ اكتساب الطلاق
او الانفصال الدرجة القطعية من تاريخ نفاذ احكام هذا القانون وذلك للعقود المبرمة قبل
