Article text
أ للشريك في ملكية بناء أو طابق أو شقة مسجلة -
بمقتضى أحكام هذا الفصل حق أفضلية في شراء أي
حصة شائعة فيها يراد بيعها بالتراضي إلى شخص من غير
الشركاء فيه ولا تطبق على هذه العقارات الاحكام
. المتعلقة بالشفعة وبحق الرجحان او اي حق آخر مماثل
ب- لا تسمع دعوى الأفضلية إذا وقع البيع بين الأصول
والفروع أو بين الزوجين أو بين الإخوة أو بينهم وبين
فروعهم حتى الدرجة الثالثة.
ج- تقام دعوى الأفضلية على المشتري لدى المحكمة
( خلال 30 ) ثلاثين يوماً من تاريخ علم الشريك بالبيع، وفي
( جميع الاحوال لا تسمع دعوى الأفضلية بعد 90 ) تسعين
يوماً من تاريخ التسجيل.
