أ -
بعض الحصة المباعة جبراً على المشتري، إلا إذا تعدد
المشترون من بائع واحد فلصاحب حق الأفضلية في هذه
الحالة أن يأخذ حصص بعضهم ويترك حصص بعضهم
. الآخر
ب- إذا تعدد أصحاب حق الأفضلية أخذ به كل واحد منهم
بنسبة الحصص التي يملكها، وإن أسقطه أحدهم انتقل
حقه إلى البقية بالتساوي بينهم إضافة إلى حصص كل
واحد منهم فيه.
