الفصل الثامن
رهن العقار رهناً تأمينيا
أ- يجوز رهن العقار، أو أي حصة شائعة فيه، رهناً تأمينياً
ضماناً لدين على مالكه أو كفالة لدين على غير مالكه.
ب- يجوز رهن العقار رهناً تأمينيا ضماناً لدين جهة رسمية أو
مؤسسة عامة كانت أم خاصة أو شركة أو بنك مصرح لأي
منهما بمزاولة أعماله في المملكة.
ج- لا ينعقد رهن العقار إلا بتسجيله لدى مديرية التسجيل.
د- تنصرف كلمة الراهن حيثما وردت في هذا الفصل، إلى
كل من المدين والكفيل، وذلك في حال كان رهن العقار
كفالة لدين على غير مالكه، ما لم تدل القرينة على غير
ذلك.
