اذا كانت الجريمة المتلبس بها مما يتوقف ملاحقتها على شكوى فلا يجوز القبض على
المشتكى عليه الا اذا صرح بالشكوى من
يملك تقديمها. ويجوز في هذه الحالة ان تكون الشكوى لمن يكون حاضرا من رجال السلطة
العامة.
