1 - يستجوب المدعي العام في الحال المشتكى عليه المطلوب بمذكرة حضور اما المشتكى
عليه الذي جلب
بمذكرة احضار فيستجوبه خلال اربع وعشرين ساعة من وضعه في النظارة.
2 - حال انقضاء الاربع والعشرين ساعة يسوق مأمور النظارة من تلقاء نفسه المشتكى عليه الى
