في مدة وجود أموال المتهم الغائب تحت يد الخزينة تعطى زوجته وأولاده ووالداه ومن يعولهم
شرعا نفقة شهرية
من واردات أملاكه تعينها المحكمة المدنية العائد اليها الامر. كما يجوز للمدعي الشخصي أن
يستصدر من المحكمة
ذاتها قرارا باستيفاء مقدار مؤقت من التعويضات المحكوم له بها في مقابل كفالة أو بدونها.
