اذا قبلت المحكمة سببا من أسباب النقض أو وجدت سببا له من تلقاء نفسها عملا بالمادة 280
قررت نقض الحكم
المميز واعادة الاوراق الى المحكمة التي اصدرت الحكم المنقوض لتحكم في الدعوى من جديد.
