يعود طلب اعادة المحاكمة:
1 - لوزير العدل.
2 . - للمحكوم عليه ولممثله الشرعي اذا كان عديم الاهلية
3 . - لزوجه وبنيه وورثته ولمن أوصى له اذا كان ميتا أو ثبت غيبته بحكم القضاء
4 . - لمن عهد اليه المحكوم عليه بطلب الاعادة صراحة
