الفصل الثاني
نقل الدعوى من محكمة الى اخرى
لمحكمة التمييز وبناء على طلب رئيس النيابة العامة نقل الدعوى الجنائية أو الجنحوية إلى مدع عام آخر أو
إلى محكمة أخرى من درجة المحكمة العائدة إليها رؤية الدعوى وذلك عندما يكون التحقيق في الدعوى أو
رؤيتها في منطقة المدعي العام أو المحكمة من شأنه الإخلال بالأمن العام أو لمقتضيات حسن سير
العدالة الجزائية.
