1 - اذا وجد في مسكن المشتكى عليه أوراق او أشياء تؤيد التهمة او البراءة أو ما يمنع القانون حيازته
. فعلى المدعي العام ان يضبطها وينظم بها محضرا
2 ( - ومن حق المدعي العام وحده والاشخاص المعينين في المادتين 36 و 89 ) الاطلاع على الاوراق قبل
