1 - يجري التقادم من تاريخ الحكم اذا صدر غيابا، ومن يوم تملص المحكوم عليه من التنفيذ اذا
. كان الحكم وجاهيا
2 - اذا تملص المحكوم عليه من تنفيذ عقوبة مانعة أو مقيدة للحرية اسقط نصف مدة العقوبة
. التي نفذت فيه من مدة التقادم
