1 - للمدعي العام في حالة الجرم المشهود المستوجب عقوبة جنائية ان يأمر بالقبض على كل
شخص من الحضور يستدل بالقرائن . أو شريكا فيه أو متدخلا أو محرضا عليه على انه فاعل ذلك الجرم
2 - وان لم يكن الشخص حاضرا أصدر المدعي العام أمراً باحضاره والمذكرة التي تتضمن هذا الامر تسمى
. مذكرة احضار
3 - يستجوب المدعي العام في الحال الشخص المحضر لدية.
