1 - اذا اجتمع في مكان التحقيق مدعي عام و أحد موظفي الضابطة العدلية يقوم المدعي
. العام بأعمال الضابطة العدلية
2 - واذا كان من حضر من الموظفين المذكورين قد بدأ بالعمل فللمدعي العام حينئذ ان يتولى
. التحقيق بنفسه او ان يأمر من باشره باتمامه
