Article text
1 - يباشر المدعي العام التحقيق في الجنايات وما يرى التحقيق فيه من الجنح، إلا إذا نص القانون
. على وجوبه في جنحة ما أو بناء على طلب من النائب العام المختص
2 - إذا كان الفعل أو الترك جناية، يكمل المدعي العام التحقيقات التي أجراها أو التي أحال
. أوراقها إليه موظفو الضابطة العدلية ويصدر قراره بحسب المقتضى
3 - إذا كان الفعل أو الترك جنحة فله ان يحيل الأوراق إلى المحكمة المختصة مباشرة أو أن يستمر
. بالتحقيق فيها وفقاً لأحكام هذا القانون
4 - وفي جميع الأحوال، يشفع الإحالة بادعائه ويطلب ما يراه لازما.
