1 -اذا وجب اجراء التفتيش في منزل شخص غير المشتكى عليه يدعى هذا الشخص لحضور

2 - فان كان غائبا او تعذر عليه الحضور يجري التفتيش بحضور مختار محلته او من يقوم مقامه او
أمام اثنين من
أقاربه او شاهدين يستدعيهما المدعي العام.
