Article text
أ- إذا لم يتنح القاضي وتقدم احد الخصوم بطلب رده عن نظر الدعوى، فيجب ان يقدم طلب الرد
إلى رئيس محكمة الاستئناف أو رئيس المحكمة العليا الشرعية حسب مقتضى الحال، مشتملاً
على أسباب الرد ووسائل إثباته مرفقاً به الأوراق المؤيدة لذلك ووصل يثبت ان طالب الرد أودع
لدى صندوق المحكمة المختصة بنظر الطلب تأميناً قدره خمسون ديناراً ويبلغ رئيس المحكمة
نسخة من الاستدعاء إلى النيابة العامة الشرعية ونسخة ثانية إلى القاضي المطلوب رده وعند
ورود الجواب منه في الميعاد الذي حُدد له يقرر تشكيل هيئة حكم برئاسته للنظر في الطلب
دون حضور الفرقاء والقاضي المطلوب رده وتقرر ما تراه بشأن هذا الجواب تدقيقاً.
ب- اذا ظهر للمحكمة أن الأسباب المبينة في الاستدعاء تصلح للرد قانوناً أو لم يجب القاضي
على الاستدعاء في الموعد المعين، تحدد موعداً للنظر في الطلب بحضور الطرفين دون إشراك
القاضي المطلوب رده وتفصل في الطلب وفق الأصول .
ج- اذا ثبت للمحكمة وجود سبب من أسباب الرد تقرر رد القاضي وإجراء المقتضى على الوجه
( المبين في المادة 128 ) من هذا القانون وإذا لم يثبت شيء من ذلك تقرر المحكمة رد الطلب
ومصادرة التأمين المقرر وقيده إيراداً للخزينة ويستمر القاضي في نظر الدعوى .
