Article text
أ- لا يقبل طلب الرد اذا لم يقدم قبل الدخول في الدعوى ان كان المتقدم به المدعي وقبل
الدخول في المحاكمة ان كان المتقدم به المدعى عليه، ما لم يكن سبب الرد ناشئاً عن حادث
طرأ بعد الدخول في الدعوى أو المحاكمة ، فيشترط في هذه الحالة ولقبول طلب الرد ان يقدم
في أول جلسة تلي هذا الحادث ولطالب الرد ان يسحب طلبه في أي وقت قبل الدخول في
موضوع طلب الرد من المحكمة المختصة، وللمحكمة في هذه الحالة أن تأمر بمصادرة نصف
( مقدار التأمين المقرر في الفقرة )أ( من المادة 129 ) من هذا القانون .
ب- لا يقبل رد عدد من قضاة المحكمة العليا الشرعية بحيث لا يبقى من عددهم ما يكفي
للحكم في طلب الرد .
ج- يجوز لطالب الرد الطعن أمام المحكمة العليا الشرعية بالحكم برد طلبه اذا كان صادراً عن
محكمة استئناف .
د- يجوز للمحكمة العليا الشرعية أن تقرر نقل الدعوى من محكمة إلى أخرى مماثلة لها لأسباب
تتعلق بالأمن العام بناء على طلب من النائب العام على انه يحق للمحكمة استدعاء طالب
النقل للتحقق من موجبات طلب النقل بحضور الطرفين .
