الفصل الثالث والعشرون
الطعن أمام المحكمة العليا الشرعية
يقبل الطعن أمام المحكمة العليا الشرعية في الأحكام الصادرة عن محاكم الاستئناف خلال
ثلاثين يوماً من اليوم التالي لتاريخ صدورها اذا كانت وجاهية ومن اليوم التالي لتاريخ تبليغها اذا
كانت قد صدرت تدقيقاً أو غيابياً أو غيابياً بالصورة الوجاهية وذلك في الدعاوى المنصوص عليها
( في الفقرة )أ( من المادة 143 ) من هذا القانون في الأحوال التالية :-
أ- اذا كان الحكم المطعون فيه مبنياً على مخالفة للقانون أو خطأ في تطبيقه أو تأويله .
ب- اذا وقع بطلان في الحكم أو بطلان في الإجراءات اثر في الحكم.
ج- اذا صدر الحكم نهائياً خلافاً لحكم آخر سبق أن صدر بين الخصوم انفسهم دون أن تتغير
صفاتهم وتعلق النزاع بالحق ذاته محلاً وسبباً وحاز قوة القضية المقضية سواء ادفع بهذا أم لم
يدفع .
د- اذا لم يبن الحكم على أساس قانوني بحيث لا تسمح أسبابه للمحكمة العليا الشرعية بأن
تمارس رقابتها .
هـ- اذا اغفل الحكم الفصل في احد المطالب أو حكم بشيء لم يطلبه الخصوم أو بأكثر مما
طلبوه.
