Article text
أ- لا يقبل الطعن أمام المحكمة العليا الشرعية على غير الأحكام الاستئنافية المشار إليها في
( المادة 158 ) من هذا القانون إلا بإذن من رئيس المحكمة العليا الشرعية أو من يفوضه .
ب- على طالب الإذن بالطعن أمام المحكمة العليا الشرعية أن يقدم الطلب إلى رئيس
المحكمة العليا الشرعية خلال عشرة أيام من اليوم التالي لتاريخ صدور الحكم اذا كان وجاهياً،
ومن اليوم التالي لتاريخ تبليغه اذا كان قد صدر تدقيقاً أو غيابياً أو غيابياً بالصورة الوجاهية .
ج- على طالب الإذن بالطعن أمام المحكمة العليا الشرعية ان يبين في طلبه بالتفصيل
النقطة القانونية المستحدثة أو التي على جانب من التعقيد القانوني أو تنطوي على أهمية
عامة تحت طائلة رد الطلب شكلاً .
د- اذا صدر القرار بالإذن وجب على مقدم الطلب ان يقدم لائحة الطعن خلال عشرة أيام من
اليوم التالي لتاريخ تبليغه قرار الإذن، ويبقى الإذن قائماً إلى حين صدور الحكم النهائي في
الدعوى .
