أ- على المحكمة التي يرفع اليها نزاع يوجد بشأنه اتفاق تحكيم ان تحكم برد الدعوى اذا دفع
المدعى عليه بذلك قبل الدخول
في اساس الدعوى.
ب-ولا يحول رفع الدعوى المشار اليها في الفقرة (أ) من هذه المادة دون البدء في اجراءات
التحكيم او الاستمرار فيها
او اصدار حكم التحكيم ما لم يتفق الطرفان على غير ذلك.
