Article text
1 - اذا أخذت المحكمة بالأسباب المخففة لمصلحة من ارتكب جنحة ، فلها أن تخفض العقوبة
الى حدها الأدنى المبين في المادتين
( 21 و 22 ) على الأقل.
2 - ولها أن تحول الحبس الى غرامة أو أن تحول - فيما خلا حالة التكرار - العقوبة الجنحية الى
. عقوبة المخالفة
3 - يجب أن يكون القرار المانح للأسباب المخففة معللاً تعليلاً وافياً سواء في الجنايات أو الجنح.
