الفصل الثالث
في التكرار
من حكم عليه بإحدى العقوبات الجنائية حكما مبرما ثم ارتكب في أثناء مدة عقوبته أو في خلال
عشر سنوات بعد أن قضاها أو بعد سقوطها عنه بأحد الأسباب القانونية :-
1 - جناية تستلزم عقوبة الأشغال المؤقتة أو الاعتقال المؤقت يضاف إلى مدة العقوبة التي
تستلزمها جريمته الثانية مقدار نصفها في حالة التكرار الأولى وفي أي حالة تكرار بعد ذلك يضاف
إليها مثلها.
2 - جنحة تستلزم عقوبة الحبس يضاف إلى مدة العقوبة التي تستلزمها جريمته الثانية مقدار
