يكون نشر الموضوع المكون للذم ، والقدح مستثنى من المؤاخذة بشرط وقوعه بسلامة نية اذا
كانت العلاقة الموجودة بين الناشر
وصاحب المصلحة بالنشر من شأنها ان تجعل الناشر إزاء واجب قانوني يقضي عليه بنشر ذلك
الموضوع لصاحب المصلحة بالنشر
او اذا كان للناشر مصلحة شخصية مشروعة في نشره ذلك الموضوع على هذا الوجه ، بشرط ان لا
يتجاوز حد النشر وكيفيته ،
القدر المعقول الذي تتطلبه المناسبة.
