أحكام شاملة للفصول الثلاثة السابقة
1 - يعفى من العقاب مرتكبو الجرائم المنصوص عليها في الفصول الثلاثة السابقة اذا وقعت
اضرار بالمجني عليه
بين الاصول والفروع او الزوجين غير المفترقين قانوناً ، او بين الاربة والربيبات من جهة وبين الاب
والام من جهة ثانية.
2 -أ- اذا عاود هذا الفاعل جرمه في خلال ثلاث سنوات عوقب بالعقوبة المنصوص عليها في
القانون مخفضاً منها
الثلثان.
ب-يشترط التطبيق حكم تخفيض العقوبة ازالة الضرر الذي لحق بالمجني عليه.
