لا يجوز للمؤم َّن له أو المؤم َّن عليه أو المستفيد عرض الصلح أو عقده فعلا مع الغير المتسبب
بالخسارة أو الضرر دون موافقة المؤم ِّن على ذلك، ما لم يكن ذلك في مصلحة المؤم ِّن.
