يشترط في المصلحة التأمينية أن تكون مشروعة وأن تثبت لمنفعة المؤم َّن له أو المستفيد أو
لهما معا عند انعقاد عقد التأمين أو عند تحقق الخطر المؤم َّن منه حسب مقتضى الحال، وإلا
كان العقد باطلا.
