Article text
أ - إذا تبين عند تحقق الخطر المؤمن منه أن القيمة الفعلية للأموال المؤمن عليها تزيد على مبلغ
التأمين المحدد في عقد التأمين يلتزم المؤمن بتعويض المؤمن له بما يعادل نسبة مبلغ
التأمين إلى القيمة الفعلية للأموال المؤمن عليها، أما إذا قلت القيمة الفعلية للأموال المؤمن
عليها عن مبلغ التأمين فيلتزم المؤمن بتعويض المؤمن له بالقيمة الفعلية للأضرار التي لحقت
بالأموال.
ب- على الرغم مما ورد في الفقرة (أ) من هذه المادة، لطرفي عقد التأمين الاتفاق على مبلغ
تأمين معين للأموال المؤم َّن عليها يدفع عند تحقق الضرر الناجم عن الخطر المؤم َّن منه ودون
حاجة لإثبات قيمة الضرر، على أن يكون هذا الاتفاق واضحا ومحددا.
