Article text
أ - يجوز التأمين من أي أضرار تلحق بالغير جراء تحقق مسؤولية المؤمن له المدنية وفقا لشروط
العقد المبرم مع المؤمن ويلتزم المؤمن بتعويض المؤمن له عما يترتب عليه من مسؤولية
مدنية تجاه المتضرر، إضافة إلى المصاريف التي يتحملها المؤمن له نتيجة مطالبته من المتضرر
قضائيا، وأي مصاريف أخرى يتم الاتفاق عليها بين طرفي عقد التأمين.
ب- يتحدد التزام المؤمن المنصوص عليه في الفقرة (أ) من هذه المادة بقيمة الضرر الفعلي أو
بحدود المسؤولية الواردة في عقد التأمين، أيهما أقل.
ج - إذا تعدد المتضررون ولم تكف حدود مسؤولية المؤمن الواردة في عقد التأمين للوفاء بقيمة
الضرر الفعلي الذي تسبب به المؤم َّن له، التزم المؤمّن بتعويض كل متضرر بنسبة من حقه في
قيمة الضرر إلى حدود مسؤوليته بموجب عقد التأمين.
