Article text
يقع باطلا في عقد التأمين أي من الشروط التالية:
أ- الشرط الذي يقضي بسقوط الحق في التعويض بسبب مخالفة القوانين إلا إذا انطوت هذه
المخالفة على جناية أو جنحة قصدية.
ب- الشرط الذي يقضي بسقوط الحق في التعويض بسبب تأخر المؤمن له في إعلان الحادث
المؤمن منه إلى الجهات المطلوب إخبارها أو في تقديم المستندات إلى تلك الجهات إذا تبين أن
التأخير كان لعذر مقبول.
ج- كل شرط لم يبرز بشكل ظاهر إذا كان يتعلق بحالة من الحالات التي تؤدي إلى إنهاء العقد أو
سقوط حق المؤمن له في التعويض.
د - شرط التحكيم إذا لم يرد في اتفاق خاص منفصل عن عقد التأمين.
هـ- كل شرط تعسفي يتبين أنه لم يكن لمخالفته أثر في وقوع الحادث المؤمن منه.
