أ- يتمتع العامل في العمل المرن بكافة الحقوق التي يتمتع بها العامل بموجب عقد العمل
ووفقاً لما نص عليه القانون، إذا لم ينص أي نظام أو عقد على حقوق أفضل ولا يجوز لصاحب
العمل المساس بأي حال من الأحوال بالحقوق التي اكتسبها العامل.
ب- تخضع العلاقة التعاقدية بين العامل وصاحب العمل لأحكام القانون في غير الحالات
المنصوص عليها في هذا النظام.
