Article text
أ- للمدين حسن النية تقديم طلب للمحكمة بالإبراء من الديون غير المسددة وعلى المحكمة
تبليغ هذا الطلب الى دائني هذه الديون ووكيل الإعسار فور وروده اليها ولهم الحق في تقديم
دفوعهم واعتراضاتهم على طلب المدين بالإبراء خلال مدة سبعة أيام من تاريخ تبلغهم الطلب.
ب- تنظر المحكمة في الطلب تدقيقاً ولها ان تقرر الموافقة على إبراء المدين من التزماته
المتبقية بعد التثبت من ان المدين قد تصرف بشكل يتفق وحسن النية على أن يتضمن قرار
المحكمة إلزام المدين بما يلي وخلال ثلاث سنوات من تاريخ صدور قرار المحكمة بالإبـراء:-
1 - ممارسة نشاط ربحي أو السعي للحصول على عمل إذا كان عاطلاً عن العمل وأن لا يستنكف
. عن قبول أي عمل يناسب مؤهلاته اذا كان المدين شخصاً طبيعياً
2 ( - دفع 50 ) من دخله المستقبلي لدائنيه، ويشمل ذلك قيمة أي أموال تؤول اليه عن طريق %
. الإرث اذا كان المدين شخصاً طبيعياً
3 - إشعار المحكمة فورا بأي تغيير في موطنه أو مكان عمله أو بأي دخل تحقق له أو أموال آلت
