Article text
أ- إذا وجدت المحكمة أن طلب إشهار الإعسار المقدم من الدائنين او المراقب موافقا للشروط
( المنصوص عليها في المادة 10 ) من هذا القانون فتتولى تبليغه للمدين مع حافظة المستندات
المرفقة به خلال مدة خمسة أيام من تاريخ تقديمه.
ب- للمدين أن يعترض على الطلب خلال مدة عشرة أيام من اليوم التالي لتاريخ تبلغه على أن
يرفق باعتراضه البينات اللازمة لإثبات دفوعه وإذا لم يعترض المدين ورأت المحكمة أن الشروط
المنصوص عليها في هذا القانون متحققة فتصدر قرارا بإشهار الإعسار خلال مدة خمسة عشر يوماً
من انتهاء المدة المنصوص عليها في هذه الفقرة.
